These Terms of Service (“Terms”) govern your access to and use of the website and services provided by MyMailMint (“we”, “us”, “our”).
By accessing our website or engaging our services, you agree to these Terms.
1. Services Overview
MyMailMint provides consulting and advisory services related to:
- Email marketing strategy
- Lifecycle and retention programs
- Deliverability and inbox placement
- ESP (Email Service Provider) setup, migration, and optimisation
- Automation and customer communication systems
All services are delivered as consulting, advisory, or managed services, as agreed in writing with the client.
2. Engagement & Scope
Each client engagement is defined by:
- A written agreement, proposal, or statement of work (SOW)
- Scope, timelines, and deliverables outlined in that agreement
If there is any conflict, the signed agreement overrides these Terms.
3. Client Responsibilities
Clients agree to:
- Provide accurate and complete information
- Ensure lawful use of their data and communication practices
- Maintain compliance with applicable laws (e.g., data protection, email regulations)
- Provide timely access to required tools, platforms, and systems
MyMailMint is not responsible for delays or outcomes impacted by incomplete access or inaccurate data.
4. Data & Privacy
- Clients retain full ownership of their data
- MyMailMint acts as a data processor, accessing data only as required to deliver services
- We do not sell or use client data beyond the scope of the engagement
All data handling is governed by our Privacy Policy.
5. Confidentiality
Both parties agree to:
- Keep all confidential information secure
- Not disclose sensitive business, technical, or customer data to third parties without consent
This obligation survives termination of the engagement.
6. Intellectual Property
Client Ownership
- All client data, campaign assets, and business information remain the client’s property
MyMailMint Ownership
- Frameworks, methodologies, templates, and internal processes remain the intellectual property of MyMailMint
Clients are granted a non-exclusive right to use deliverables created specifically for them.
7. Fees & Payments
- Fees, payment terms, and billing cycles are defined in the client agreement
- Payments must be made as per agreed timelines
- Late payments may result in:
- Suspension of services
- Delays in delivery
8. No Guaranteed Results
While we apply proven strategies and expertise:
We do not guarantee specific business outcomes, including:
- Revenue increases
- Open rates or click rates
- Deliverability results
Results depend on multiple external factors including:
- Market conditions
- Customer behavior
- Platform algorithms
- Data quality
9. Limitation of Liability
To the maximum extent permitted by law:
- MyMailMint shall not be liable for:
- Indirect or consequential damages
- Loss of revenue, profits, or data
- Our total liability shall not exceed the fees paid for the services in the preceding period (e.g., 3–6 months)
10. Third-Party Tools & Platforms
Our services may involve third-party platforms (e.g., ESPs, analytics tools).
We are not responsible for:
- Platform outages
- Policy changes
- Deliverability restrictions imposed by third parties
11. Termination
Either party may terminate the engagement:
- As per the terms defined in the agreement
- With written notice (if applicable)
Upon termination:
- Access to systems may be revoked
- Outstanding payments remain due
12. Non-Solicitation (Optional but Recommended)
During the engagement and for 6–12 months after termination, clients agree not to:
- Directly hire or solicit MyMailMint team members without prior written consent
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India / Karnataka.
14. Changes to Terms
We may update these Terms periodically. Continued use of our services constitutes acceptance of the updated Terms.
